Doyle Lowther Appointed Interim Co-Lead Counsel In Litigation Against Sony For Defective VAIO Laptop Trackpads

On January 20, 2009 Doyle Lowther LLP was one of two firms appointed interim co-lead counsel in litigation pending against Sony Electronics and Best Buy. The litigation arises from Sony’s alleged sale of Sony VAIO laptops with defective trackpads and touchpads.

Consumers report frustrating trackpad/touchpad errors when using their new Sony VAIO laptops. The trackpad errors include the cursor moving in a direction opposite to the user’s input, programs randomly opening and closing on the Sony VAIO laptop, and the VAIO trackpad freezing or otherwise becoming unresponsive to users’ input.

Sony VAIO laptop owners report having returned their units for repair, updating device drivers, and even reinstalling the Windows operating system and programs. But even after the attempted repairs, the Sony VAIO trackpads and touchpads continue to malfunction, rendering the Sony VAIO laptops inoperable. Consumers allege the Sony VAIO laptops are defective.

The litigation against Sony alleges violations of consumer protection statutes, unalwful and unfair business practices, breaches of warranty, negligence and unjust enrichment. The litigation currently is pending in the United States District Court, Southern District of California, In re Sony VAIO Computer Notebook Trackpad Litigation, Case No. 09-CV-2109.
